Your Consumer Rights

The FDCPA protects you in the context of personal and household debts. These types of debts include credit card debt, medical bills, mortgages and car loans.

Here are some of the rules that provide consumers with protection under the FDCPA:

  • Debt collectors are prohibited from calling you excessively/repeatedly or before 8 a.m. and after 9 p.m.
  • Debt collectors cannot call you at work if you informed them of this fact.
  • Debt collectors cannot inform or ask about your debt with family members, friends or your employer.
  • Debt collectors are prohibited from using obscene/profane language and threats of violence/physical harm.
  • Debt collectors cannot make false threats of taking legal action.
  • Debt collectors cannot threaten to take away your property (if they are legally unable to do so).
  • Debt collectors cannot lie or make false statements, including misrepresenting what you owe.

You can stop creditor harassment by obtaining an attorney or filing for bankruptcy. Once creditors are informed that you are represented by an attorney, they can no longer contact you and must only contact the attorney. Furthermore, once you file for bankruptcy, there is an automatic stay placed on creditors and they must immediately stop all collection actions.
