A Changing Landscape

As our economic climate continues to deteriorate, we are seeing people who need to file for bankruptcy with higher incomes than ever before. If you are considering bankruptcy, or preparing to file bankruptcy, you are not alone.

Although people from many different walks of life are declaring bankruptcy, there are some common concerns shared by almost everyone:

Will everyone know that we have declared bankruptcy?

  • Generally, no.
  • Although the information is technically public, it's not usually broadcast on TV or radio, or printed in the newspapers; someone would have to really search to find out that you have declared bankruptcy.

What will bankruptcy do to our credit rating?

  • Generally, very little.
  • If you are declaring bankruptcy, it is probably because you have missed some payments, which means your credit score is already damaged. Bankruptcy may slightly lower your score in the beginning, but it will improve your credit rating in the long run, because it will eliminate any delinquent accounts being reported.

Will we ever be able to get a car or home loan again?

  • Generally, yes, so long as you maintain a good payment history to rebuild your credit after your discharge.
  • Three years after a Chapter 7 discharge, you can be eligible for an FHA-conforming loan again, as long you have otherwise kept your credit in good shape.

Is it Possible to File for Bankruptcy Again in the Future?

  • Yes.
  • There are different waiting times for Chapter 7, Chapter 13, and Chapter 11, but generally you are legally able to file for bankruptcy more than once.
