For those who are looking to have some of their debts discharged, giving them a chance to start over again, Chapter 7 is a great option. Chapter 13 also provides an opportunity to restructure debt and discharge any remaining unsecured debt. While bankruptcy does discharge debts, not all debts are dischargeable. These "nondischargeable debts" are still owed, regardless of a bankruptcy filing. It is important to completely understand how bankruptcy will affect your debt situation.

Nondischargeable Debts

Some debts cannot be discharged. These are called nondischargeable debts. In other words, the creditor can still collect for these debts even though you may have filed for Chapter 7 or Chapter 13 bankruptcy as well as Chapter 11.

Nondischargeable debts include but are not limited to:

  • Taxes less than three years old
  • Credit card charges for luxury goods within the last six months
  • Most debts arising from a divorce decree, such as alimony
  • Child support
  • Debts incurred by fraud
  • Most school debts such as student loans (unless in some cases deemed a hardship)
  • Debts arising from willful or malicious injury to another person

However, keep in mind there are also nonbankruptcy options for solving your debt problems. We will analyze all relevant factors in your case to determine the best alternatives for you.
